Race Participant Release and Waiver

Assumption of Risk and Waiver of Liability:

I, the parent or legal guardian of the below named participant (the "Participant") acknowledge that participating in the GBH 5k: Run for Public Media Fun Run (the "Event" or "Race") is a potentially hazardous activity.

I assume any and all other risks associated with the Participant taking part in the Event, including but not limited to, falls, contact with other Event participants, staff or spectators, slippery or uneven surfaces, the effect of weather including high heat and/or humidity, and the possibility of being infected with the virus causing COVID-19, all such being known and appreciated by me.

While preventative measures have been put in place to reduce the risk of spreading COVID-19, WGBH Educational Foundation (“GBH”) cannot guarantee that Participant or other attendees will not be exposed to or become infected with COVID-19.

By attending or participating in the Event, I am certifying that: (1) I understand that COVID-19 is extremely contagious and is spread mainly from person-to-person contact, (2) the Event will not be socially distanced, (3) any interaction with others in connection with the Event may expose Participant, me and my family to and increase the risk of contracting and spreading COVID-19, (4) there is no known cure for COVID-19, and (5) scientific evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death. Participant is voluntarily attending or participating in the Event and , on Participant’s behalf, I assuming the known and unknown risks of exposure to, contracting, and/or spreading COVID-19 as a result of attendance or participation.

I acknowledge that it is my responsibility to understand the risks and determine whether Participant is fit to safely complete the Event and the precautions that should be taken. I certify that my Participant’s physical condition and ability to safely complete the Event have been verified by a licensed medical doctor (except where the latter is in violation of religious principles); and that Participant is physically fit.

All attendees and participants must comply with GBH Safety Guidelines, as communicated by GBH employees before or during the Event and any applicable governmental orders with regard to COVID-19 (the “Orders”). Failure to comply with GBH’s Guidelines or the Orders may result in immediate removal from the Event, at GBH’s sole discretion. If Participant is removed from the Event due to such noncompliance, I understand that the ticket price and any other fees paid or expenses incurred to travel to, attend, or participate in, the Event with be forfeited.

In addition, by attending this Event, I certify that Participant (1) does not have COVID-19, (2) has not had known or suspected exposure to COVID-19 within the last fourteen days, (3) has not had a positive test result for Covid-19 in the past ten days, (4) is not experiencing any COVID-19 symptoms (e.g., fever or chills, cough, shortness of breath, fatigue, aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, diarrhea), and (5) GBH reserves the right to request Participant provide proof of a negative COVID-19 test (PCR or antigen) taken within 48 hours of the start of the Event, in which case GBH will provide as much advance notice as possible.

WAIVER OF LIABILITY: BY ATTENDING THIS EVENT, I HEREBY FOREVER RELEASE AND WAIVE, on behalf of PARTICIPANT, myself, AND OUR RESPECTIVE heirs, executors, administrators and anyone else who might claim on my OR PARTICIPANT’S behalf, ALL CLAIMS AND RIGHTS AGAINST GBH, all race sponsors, the Commonwealth of Massachusetts and its agencies and departments including, but not limited to, the Department of Conservation and Recreation, the City of Boston and Town of WatertowN, Granite State Race Services LLC, and Each of their respectIve employees, Trustees, directors, officers, officials, Contractors, volunteers, agents, and Representatives (collectively, THE “RELEASED PARTIES”) From any and all claims or liability for Death, bodily or personal injury, or property damage or loss including, but not limited to, Exposure, INfection and/or Spread of Covid-19 RELATED TO participation IN THE EVENT SPONSORED, ORGANIZED, HOSTED OR OFFERED BY GBH. I UNDERSTAND THAT THIS WAIVER MEANS I GIVE UP MY OR PARTICIPANT’S RIGHT TO BRING ANY CLAIMS INCLUDING FOR PERSONAL INJURIES, DEATH, DISEASE OR PROPERTY LOSSES, OR ANY OTHER LOSS INCLUDING, BUT NOT LIMITED TO, CLAIMS OF NEGLIGENCE, AND I GIVE UP ANY CLAIM I MAY HAVE TO SEEK DAMAGES, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN. I SPECIFICALLY GIVE UP MY AND PARTICIPANT’S RIGHT TO INITIATE SUIT AGAINST THE RELEASED PARTIES FOR ANY MATTER CONTEMPLATED BY THIS WAIVER OF LIABILITY.

Permission to be Recorded. I, further grant GBH full permission to record and use my and Participant’s name, likeness and voice, my participation in the Event, and all other aspects of the Event ("Recordings"). I further grant, forever, GBH and its licensees permission to use any or all portions of the Recordings in any and all media known or later developed, worldwide, for any purpose.

Consent to Treatment, including Treatment for Participants under the age of 18:
In the event of an emergency, I do grant permission to officials of GBH and other entities assisting in the Event (collectively, "Emergency Entities") to provide onsite medical treatment to, and if needed, transport Participant to a hospital emergency room for medical or surgical treatment. GBH agrees to take every step possible in contacting, as appropriate me or my next of kin or other emergency contact, at the number provided on the registration when any such situation may occur. Whether for Participant or as the parent/legal guardian, I give full authorization to Emergency Entities and their medical staff, employees, agents and/or subcontractors to secure medical care or treatment for me or for the Participant. This treatment may include assistance from approved and licensed medical staff providing medical care at the event, the nearest physician, hospital, trained nurse or EMT in the event of illness or injury that requires immediate attention, as determined by the Event staff. In the event that I cannot be contacted, and an emergency has occurred, I give permission to the treating medical institution and/or medical providers to hospitalize and administer the appropriate treatment deemed medically necessary. I grant to Emergency Entities and their medical staff and designees access to Participant’s medical records and physicians, as well as other information relating to medical care that may be administered to Participant due to Participant’s participation in the Event. I acknowledge and agree that I am responsible for any payments due to any service providers who furnish any such treatment, including emergency medical transport services, and I authorize the Emergency Entities to provide contact information for me to any medical service provider seeking such payment.

The Race Director reserves the right to reject any entry or Participant. Participant acknowledges that the entry fee paid is non-refundable and non-transferable. I acknowledge and agree that GBH or the Race Director, may delay or cancel the Event if it/he/she believes the conditions on the race day are unsafe or for other reasonable causes. Should the Event be delayed or cancelled for any reason or cause beyond GBH's control there shall be no refund of the entry fee or any other costs of incurred by me or Participant in connection with the Event. In no event shall GBH or any of the Released Parties be liable for consequential or indirect costs or damages of any kind resulting from the Event, participation in the Event, or any delay or cancellation of the Event.

I HAVE READ THE FOREGOING AND INTENTIONALLY AND VOLUNTARILY SIGN THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT.
